Florio apologized to the staff after it was discovered he was involved in racist behavior with his Gallaudet University college fraternity. There have been reports that the Kappa Gamma Fraternity wore robes similar to those of the Ku Klux Klan and made an apparent Nazi salute in a photograph.
Florio lawsuit claims he was instructed to apologize by his superiors and he was just following their orders. The lawsuit says the decision to fire him "...was based on a series of manipulated, misleading, biased, and fabricated internal complaints purportedly unrelated to his fraternity membership."
The Executive Office of Health and Human Services has not responded to the suit.
